1. Ensuring Anti-Discrimination Laws Stand the Test Time
In section 51 (xxvi) of the Australian Constitution is commonly known as ‘the races power’. Such provision that was provided by this section allows the federal government to legislate for “the people of any race, for whom it is deemed necessary to make special laws”. Justice Gummow and Justice Hayne of the High Court in the Hindmarsh Island case perceived that the race power could be used to confer either benefits or disadvantages upon a particular race.
