2. ARRIVAL AT THE SCENE:
Upon my arrival at the stop, I observed a Black Dodge Pick-up, NJ Reg: KYB16P on the embankment near the Cattell Soccer Fields, just off the roadway. I then spoke with P/O Bullock who advised he observed this vehicle stopped on the grass when he was enroute to a call for service. P/O Bullock advised that his observation was the driver was asleep behind in the vehicle. The vehicle was also running while still in “Drive” with just his foot on the brake pedal. P/O Bullock attempted to wake the driver but was unsuccessful at first. I then approached the driver, who is now identified as Robert P. Denight. Robert was then asked to step out of the vehicle which he nearly fell when doing so. I asked Robert to walk back to the rear of his vehicle and began to engage in conversation with him when I noticed a strong odor of an alcohol beverage emanating from his breath. Robert advised he just stopped his vehicle on the roadway as such because he was extremely tired from work. When asked if he consumed any alcoholic beverages Robert stated, “a few beers.” At this time, I advised Robert I was going to administer SFST’s to him. The first test I administered was the HGN test.

After Robert advised me that he did not, I explained to him the instructions, to which he advised me that he understood. I began the test and Robert moved his head as I moved my stimulus (pen). I advised him to follow my pen with his eyes and do not move your head. I observed a lack of smooth pursuit in both eyes. I could also observe there was a distinct and sustained nystagmus at maximum deviation. There was also nystagymus prior to forty-five (45) degrees in both eyes.
