Recently, Antonin Scalia, one of the eight associate supreme justices died at the end of Barack Obama’s term which is causing major controversy for the next supreme justice that will fill his vacancy can cause a significant power shift to liberals in the Supreme Court justice union. With only 8 Supreme Court justices left there is an equal balance between liberals and conservatives in the Supreme Court justice union (4-4). The next supreme justices to fill the vacancy of Antonin Scalia will break that 4 to 4 tie and give the power to either the liberals or the conservatives. If a liberal is put to be the new supreme justice it could change the way the Supreme Court deals with cases that are similar to past cases that have set precedents in which the court declare certain acts constitutional or unconstitutional. With Conservatives having to rule the court 5 to 4 for decades the change of liberals coming on top on a 5-4 decision they have the supremacy to uphold or break old laws and precedents changing the way federal laws are dealt with. Essentially, with the senate’s decision on fighting against Obamas’ nominations of a new supreme justice it could lead to a filibuster which will delay the voting process of a new supreme court until next January when the new president is in office serving his first term. The SCOTUS will still have to go to deal with pending cases with eight supreme justices that will most likely will result in 4 - 4 ties leaving the lower court decisions to be upheld. Importance cases involving abortion, affirmative action, and voting rights in which Scalia were all opposed to would have been denied and deemed unconstitutional but with Scalia presence missing these cases have a high chance of having a
