The first section of the bill amends Section 46.01 of the Penal Code by adding Subdivisions (18), (19), and (20) to include definitions on “Gun Show,” “Gun show promoter,” and “Websites for firearm sales.” This section simply allows for clarity on words that are being used in the bill, as to remove any ambiguity on the definitions.
The second section of the bill amends Chapter 46 of the Penal Code by adding Sections 46.065 and 46.066. Section 46.065 focuses on certain requirements relating to sales at gun shows. This section delineates the offense one commits when they knowingly sell a firearm at a gun show without complying with a background check, as a Class A misdemeanor. This offense also applies when a person sells a firearm to another person at a gun show and does not maintain a record of sale. This section additionally, makes it clear that a person who conducts a criminal background check may charge a fee in an amount equal to the cost incurred by the person to obtain the background check, which means that the Texas Government is not directly funding this bill, rather the seller may just charge an extra fee for the background check that they will have to run through the federal government.
