Kyle gives a meaningful name to his own business ---Alabama’s Best Food, because he thinks this name will stick to the plates and palates of his patrons. Making an impressive name could improve the effect of new products’ brand and help the new product communicate an identity. But at the same time, does Kyle imagine that one day he will receive a certified letter about infringing upon the right of another business company’s name? The company is Arkansas Best Freight (ABF), which is a well-known, nation-wide trucking company. Based on one point that the Trademark Dilution laws protect the famous trademarks from certain unauthorized uses even when the use is on non- competing goods, unlikely to confuse. Such as Kyle’s business focus on the market which is about hot sauce, salsa, and condiment lines and beyond seasonal produce, while the Arkansas Best Freight is a trucking company. Thus, Kyle is alleged harm to the trucking company’s business interests including infringements of and dilution of its trade name. But I want to give some advice to him as his friend based on another different analysis. Mark is more likely to lessen the value of a famous mark when the companies using the marks provide related goods or compete against each other in the same market. I think the likelihood of dilution between these two businesses is not enough to establish dilution.
