Trial counsel was ineffective for failing to challenge the admissibility of the ballistics expert’s testimony and findings after Bernadette Davy admitted to falsifying test reports in an unrelated case.

Davy resigned April 1, 2009, after a GBI official found out in March of 2009 that Davy had falsified a report of a case that was being prepared for trial in Douglas County, according to GBI spokesman John Bankhead.

Davy tested a gun to see how much pressure was needed to pull the trigger and instead of pulling the trigger the required dozen times, she pulled it 10 times. The discrepancy was discovered during a peer review of Davy’s work.
