Burgess Garcia Case Summary

SUMMARY:

This supplemental report documents my arrest of S1 Burgess Garcia. INVESTIGATION:

On Sunday, 12/10/2017, at approximately 0930 hours, I was in full police uniform driving a marked Daly City Police patrol unit, in the area of Peoria Street and Roosevelt Street, Daly City. From our team briefing at the beginning of shift, I was made aware of an incident which occurred on 12/09/2017. S1 Garcia was identified as the driver of VEH#1, which recklessly evaded him following a traffic stop. See Officer Soyangco's original narrative report for details.

I began checking the streets surrounding S1 Garcia's residence, located at 64 Peoria Street, Daly City. At that time I saw a male sitting on a motorcycle parked on the street in front of 64 Peoria Street. As I drove closer, I recognized him to be Garcia. I immediately exited my patrol vehicle, stated "you Burgess?" and he replied "Yeah", I drew my duty pistol and pointed it at him, ordering him to get on the ground. I advised San Mateo County communications I had a subject at gunpoint and requested one unit to respond code 3. Garcia was compliant and laid on the ground per my order. I read him his Miranda rights from a department issued Miranda card. I asked him if he understood each of his rights as I had explained them to him and he told me "yes". Garcia told me the following:
