Complainant alleges that she was subjected to different terms and conditions of housing based on her race when Respondent sided with her non-African-American upstairs tenants, when they complained about her. Respondent asserts that it issued Complainant a 30-day notice because she caused disturbances, harassed other tenants, she demonstrated aggressive and hostile behavior toward management and other tenants, and she failed to pay her full portion of the rent per the Chicago Housing Authority’s Housing Assistance Program.

While the evidence shows Respondent’s inability to manage its building, the investigation did not reveal and no evidence has been presented which shows that these occurrences altered the terms and conditions of Complainant’s housing. The evidence shows that Complainant’s lease is silent on the use of the common area storage and does not gave her exclusive rights to the storage area as she has asserted. The evidence shows that Respondent received eight complaints (e-mails and or text messages) from Andrea about Complainant’s actions as to the storage area and other harassing behavior (profanity and or moving personal items). The evidence clearly shows that Respondent informed Complainant and her upstairs tenants to stop using the storage area in an attempt to eliminate the growing hostility between the tenants. The evidence does not suggest that Respondent’s action were not severe or pervasive enough to rise to the level of harassment. The evidence does not suggest that Respondent sided with the upstairs tenants over Complainant and the issuance of the 30-Day notice appears reasonable based on the
