INTRODUCTION:

This case involves the suspect being arrested for driving under the influence of alcoholic beverages in violation of CVC 23152(a)-DUI and CVC 12500(a)-Unlicensed Driver.
LOCATION DESCRIPTION:
This incident occurred on Orange Grove Boulevard and El Molino Avenue.

INVESTIGATION:

On 01-06-17 at 1922 hours Officer Petrella #7035 and I were traveling west on Orange Grove Boulevard approaching El Molino Avenue. I observed a 2001 Tiel Nissan Sentra California license plate #7EAZ009 traveling south on El Molino Avenue approaching Orange Grove Boulevard. The vehicle stopped for a red traffic signal light at the above intersection.

I continued traveling westbound in the number two lane on Orange Grove Boulevard. The above vehicle suddenly made a right turn onto westbound Orange Grove Boulevard and nearly collided with my patrol unit (#30) in violation of CVC 22107-Unsafe Turn. The vehicle then made a lane change

I approached the driver’s door and contacted Suspect Ernesto Villalba-Rodriguez.

I observed that Rodriguez’ eyes were watery and bloodshot. I had Rodriguez step out of the vehicle and directed him to the west sidewalk on Madison Avenue. I saw that Rodriguez was unsteady as he walked to the sidewalk. I handcuffed and detained Rodriguez pending further investigation. The handcuffs were double locked. I then had Rodriguez sit on the west curb line.

Rodriguez did not understand English and requested a Spanish speaking officer to translate. Officer Salinas #786 arrived at our location to assist me with the Spanish translation.

I removed the handcuffs from Rodriguez and directed him to the west sidewalk of Madison Avenue. The concrete on the sidewalk slopes to the south and was lit by patrol unit #30 spotlight and my handheld flashlight. Rodriguez was facing north during the standard field sobriety
