The Petitioners name is Dethorn Graham. Dethorn Graham lived at 2824 Mayfair Avenue. He was employed with the North Carolina Department of Transportation in maintenance and as a patch foreman. A patch foreman performs the work and oversees the work of a crew that repairs potholes on the North Carolina roads. Mr. Graham performed this work for seven to eight years and lived in Charlotte, North Carolina since 1968.
On Mr. Graham’s days off he also did mechanical work on cars. In the early afternoon hours of November 12, 1984, Mr. Graham was working on an automatic transmission. He looked up and saw the face of a girl he recognized, Maggie Black. Mr. Graham also recognized the face of the officer. While all this was happening Mr. Graham was having a diabetic attack. He remembers there being at least three other officers on top of him. After a few minutes went by Mr. Graham realizes he was pulled to the ground and handcuffed. He said he remembers being pushed and shoved then thrown to the ground and handcuffed while three or four officers were on top of him. After the cuffs were on Mr. Graham as he lied face down on the ground he did not know how he had gotten there. He realized he must have passed out moments before. After the handcuffs were on he was “snatched up” off the ground. The officers pulled his shoulders back and pulled him up using his arms and shirt collar. Mr. Graham knew he had to let the officers know what was wrong with him. He always carried a card in his wallet with a diabetic decal so if he were unconscious someone could see he was having a medical emergency. Mr. Graham began to move around trying to get his wallet.
