Edward Cooper Case: Violation Of Public Intoxication

INTRODUCTION:

This case involves the suspect being arrested for public intoxication and unable to care for himself in violation of PC 647(f)-Public Intoxication. The suspect also had an outstanding arrest warrant.

INVESTIGATION:
On 10-24-17 at approximately 1228 hours, I was dispatched to 80 S. Oakland Avenue (Christian Science Church), regarding a male transient laying down against the church’s front door with trash surrounding him. The reporting party described the male as being White, wearing a grey shirt and dark pants, NFD.
Upon my arrival, I saw a male White, later identified as Suspect Reid Edward Cooper sleeping on a bench located near the front door of the church. Cooper fit the description which was given by the reporting party. I

Cooper stood up and began swaying approximately one to two inches from side to side. I noticed that Cooper’s speech was slurred and he appeared to be under the influence of narcotics. I observed that Cooper’s eyes were watery and bloodshot. I checked Cooper’s eyes and saw that he had lack of convergence in his left eye.
I also saw a marijuana pipe and a shirt laying on the ground directly next to the bench where Cooper was sleeping. I asked Cooper if the marijuana pipe belonged to him. Cooper admitted the marijuana pipe belonged to him and that he smoked marijuana earlier during the day, NFD. I saw a burnt substance inside of the pipe, which smelled like burnt marijuana. I then noticed that Cooper kept nodding off and falling asleep as I spoke with him.
Based on Cooper’s objective symptoms of intoxication, I formed the opinion that he was under the influence of marijuana and was unable to care for himself in public. I conducted a records check on Cooper through PPD Dispatch and learned he had an outstanding arrest warrant (see attached printout). I handcuffed and arrested Cooper for PC 647(f)-Public Intoxication and the warrant. The handcuffs were double
