In comparing Packer’s crime control and due process models the most notable difference is the way in which defendant are handled once in the court process (Bohm & Haley, 2011). In the due process model, the defendant is presumed innocent until they have had a trial and proven not only factually guilty but also legally guilty. In the crime control process, the defendant is presumed guilty and given a plea bargain to forego having a trial.

In comparing the two models to determine which process is more equipped to deter criminal activity, I have determined the crime control model is more effective. The crime control model relies upon the law enforcement officers to do a thorough investigation and obtain all the facts that prove the suspect's guilt prior to filing the charges against them (Bohm & Haley, 2011). Once the suspect enters the court system the evidence and facts are strong enough that a trial is unnecessary, consequently, the defendant is more apt to accept a plea bargain entering a guilty plea. In the crime control model, plea bargaining is used to finalize cases quickly which allows for justice to be carried out in a timely manner eliminating challenge and appeal.
