At a simple glance, surrogacy seems to be a very ideal alternative for couples who wants to have their own child, but were unable to produce their offspring due to infertility or other medical causes, and for poor surrogate mother who is in grave need for money. It seems, that it is a win­win situation for both sides, however, the bitter truth reveals something else. Due to lack of laws and legislation, surrogate mothers and prospective parents are somehow exploited and profited from, by middlemen and commercial agencies. The ambiguity of the situation, and no apparent transparency in the whole system, as well as the chance of getting involved in legal problems is there, because most regulations in India regarding surrogacy proves to be unreliable as well as unpredictable at cases. Infertile couple who went to India to have a child, were constantly and tremendously frustrated because, not only do they have to cope with the language barrier but also, almost always, couples had to fight a long legal battle to get their child(ren). Even if everything goes as planned, the couple still had to wait at least 2­3 months for the completion of the legal formalities after the birth of the baby. “
