The Second Amendment, the Unnecessary Right According to the material covered in the third chapter of the book, American Federal government (2016, O’Connor, p.93) “Civil liberties are the personal guarantees and freedoms that government cannot abridge by law”. They are explicitly identified in the Bill of Rights and Constitution. Many of these freedoms and basic rights are indispensable and necessary for a stable and fair society. However, The Second Amendment is the opposite. It is an unnecessary and undefined amendment that could only work through regulations. According to the framers, The Second Amendment was established in order to prevent governmental tyranny. However, there is no specification or requirement that …show more content…
The amendment was establish in 1791 due to the raising fears of the antifederalists and their need to ensure that the congress would not pass laws against state militia. At that time, the country was going through a lack of confidence crisis because the states distrust other states and the idea of a central government. However, nowadays all of those fears and distrust are vanished because the Department of Defense, the government and the states work hand by hand to ensure our safeness and security. In other words, they need to each other in order to make work the country properly. In addition, since the department of police and defense have demonstrated that they are able to protect the security of individuals and our country, the need for bearing a gun in order to protect our individuals is unnecessary. On the other hand, there are many arguments that are pro guns and conceive the idea of bear a gun as a sport or recreational uses. However, there are many other alternatives of non-lethal guns such as airsoft guns or salt guns that can be used for the same recreational purposes but without having the risk of take away a life. The First attempt to implement fire guns regulations was in 1920 due to the hatred for the slaves in southern states. Even though some statutes were established those could not being reviewed by a federal law due to the 1833 Supreme Court’s decision.However, it was a good attempt not in term of circumstances but in terms of regulations in order to set a limit on fire gun uses. On the contrary, the rejection of the national firearms act and the incorporation of the second amendment have just contributed to increase the level of violence. For example, the 2012 Aurora shooting in which “12 people were killed and 70 were injured due an individual with mental problems shows the lack of strict regulations in terms of licensing, psychological test and background check. These just facilitated the perpetrator to purchase the gun. At the same time, this case opened a big question mark about the kind of people that should be allow to purchase a gun or get a license. This kind of examples support the idea to endure gun regulations is essential.
