Mr. James Whitman was pulled over by Officer Jack Marshal around midnight on December 12, 1997 for drunk driving. The officer decided to pull Mr. Whitman over because he was weaving in and out of driving lanes. Officer Marshal claimed that Mr. Whitman would not pull his car over after disobeying several traffic laws. According to Mr. Whitman, Officer Marshal was staying in his vehicle for a while after he was pulled over. Mr. Whitman, then proceed to get out of his vehicle to address the officer. Once Marshal saw him exiting his vehicle and thinking he was trying to flee by foot, he subdued Mr. Whitman by an approved method of his police department. Whitman’s blood alcohol test showed a content of 0.08, which is over the legal driving limit, he was to be booked for DUI, resisting an arrest, and fleeing and eluding. I believe that Officer Marshal used his discretion correctly in pulling Mr. Whitman over to be assessed for drunk driving. However, Officer Marshal should have not physically harmed Mr. Whitman for his behavior. Officer Marshal should have also been swift to approach Mr. Whitman’s vehicle. It is important that Officer Marshal does file a DUI charge because his blood alcohol content was that over the legal limit. In addition, Mr. Whitman has the ability to file a misconduct charge against Marshal due to the cut near Mr. Whitman’s eye. Prior to this event, Mr. Whitman had a checkup with a physician that confirmed that he was healthy and that there was no cut above his eye. This proves that his statement about Officer Marshal harassing him was true. A few months prior to this occurrence, Official Marshal had another misconduct incident with Mr. Bigby. Due to this being his second offence, it is necessary that Officer Marshal be dismissed from the Bolton Police Department.
