“Pity the modern executioner.” Is the first sentence in Jeffrey Toobin’s article which is called “Cruel And Unusual.” This article was published in the December 23rd & 30th, 2013 issue of The New Yorker magazine. Jeffrey Toobin graduated from Harvard University in 1986. Years after his graduation he had been given an opportunity to work with The New Yorker magazine. The New Yorker is a very notable magazine it has been around since 1925. Currently, Jeffrey Toobin is still employed by The New Yorker and he is also employed by CNN as their senior legal analyst. The article Jeffrey Toobin wrote did have credibility because Toobin was an Assistant U.S. Attorney in New York. During the time when he was an Assistant U.S. Attorney the death penalty was legal in the state of New York. Although it did have minor limitations on it. He also begins to build credibility in his article by giving specific dates and by giving facts. Which in turn establishes that research was done before this article was written. Furthermore, Toobin's attempts to appeal to the readers emotions became stronger from paragraph three to seven. Throughout his piece, Toobin uses a variety of sources that strengthen his credibility and appeal to ethos. Jeffrey Toobin was effectively able to implement ethos, pathos, and logos in this article. The reader was able to clearly understand his thesis and understand the tone of this article. Jeffrey Toobin is also a credible source because of his past careers. Also because of the credibility of The New Yorker
