Justice Abe Fortas believes students have full rights in expressing their opinions against the Vietnam war by wearing black armbands. “The prohibition of expression of one particular opinion…is not constitutionally permissible,” said Fortas. Fortas is portraying the fact that you can not take away the rights of a student at all. “In our system, undifferentiated fear or apprehension of disturbance is not enough to overcome the right to freedom of expression,” Fortas stated. Justice Fortas believes that the fear of conflict is not enough to take away the protesters’ rights. Students should not lose their rights, even if it is during school hours. It also does not matter if it is controversial or not. School are not allowed to take away the rights of students. “The vigilant protection of constitutional freedom is nowhere more vital that in the community of American schools,” claimed Fortas. Justice Fortas believes it is very important to allow students full rights in a school day. It is entirely important for the development of the student’s opinions. Protesting is what the United States is built on. The arguments he has been making are extremely valid.
