During his midnight-to-eight shift, Officer Johnson received a dispatch on his radio noting that there was an “Amber Alert” out for a missing child in the area nearby. As the Officer made his way to the area, he noticed that a sports car in the area was having some troubles at a light that either meant the driver to be impaired or that he was having ignition troubles with the vehicle. It was only logical for the Officer to pull over with the sports car, because he was able to gain a better understanding of what was actually happening, and whether it was something with the driver or the vehicle. With the law, it is illegal to continue to detain a person that has not committed a crime or has no offense against them. In this scenario, the Officer continued to hold the driver of the vehicle, without reasoning. The Officer stated that the driver looked “nervous”, which is not enough to keep a person detained. Officer Johnson searched the suspect, and placed him under arrest due to marijuana that was found and a pot pipe that was located in the suspect’s pocket. The suspect has held in the backseat of the patrol car while the Officer continued to search through the vehicle. The Officer’s actions are not justifiable in this case, as the suspect was just deemed as nervous, and being in a situation where they did not do anything wrong besides for meaningless vehicle troubles, they have every right to be nervous. The actions that were taken by the Officer to the suspect show misconduct from the Officer himself and he used his status and intimidation to his benefit to scare the
