1.The three most important factors in deciding Mr.Asbell’s in the N.J Supreme Court would be one breaking of the fourth-degree. Mr.Asbell made a false report to the police and lead them on a chase for a crime which never happened. Then it was not until April 24, 1990 he admitted to lying about the whole incident and won’t carry a firearm for three years. No one wants a prosecutor who makes up lies and abuses the power of the law for no reason. Another point would be how he had a mental disorder with mixed disturbance and of emotions and conduct. A prosecutor should first try to fix his mental issues before even becoming a prosecutor. It can affect his judgment in many ways considering how he had a mixed personality disorder with histrionic mixed disturbance. The last important factor would be how he attracted widespread attention with his story. Even though many people saw him as an effective prosecutor and many respected him. The balancing the court must do is that he must pay for his actions. He needs to be shown that making a false report is not acceptable by any means. Also, he needs to be sent to a mental institution, so he can get help with his issues. He must show improvement if he wants his job otherwise he won’t be rehired. He even carries guns in his car and it is very dangerous considering his mental problems. He might accidently use them on someone and hurt them. From the story he told tells us that his mind is not in the right place. The court has told Mr.Asbell to reimburse the Ethics Financial Committee for all that he costed them. First the court must figure out the whole investigation because his ethical violations were not fully investigated.
