A quote from the movie Bad Boys II, which mean that any American who engages in a criminal act will have a significant debt to pay toward the society. “Before the twentieth century, Washington, D.C and the federal government did not have much to do with criminal justice; this was mostly a job for the states”. When talking about criminal law is a body of rules or statues that defines conduct prohibited by the government because it threatens and harms public safety and welfare that establishes punishment to be imposed for the the commission of such acts Cornell,(2010web), there are a lot of things that can be talked about. There are three different categories that authorities will classify your crimes as and what are these categories (Mckever Survey)? A felony which is an act that involves serious misconduct that is punishable by death or by imprisonment for more that on year, misdemeanor which is misconduct for which the law prescribes punishment of no more than one year in prison, and violations which are lesser offenses, such as traffic and parking infraction. Depending on the severity of the crime that was committed and the acts involved to commit the crime amongst many other things will be the dealing factor on what category of crime that they will charge you with (Mckever Survey ). These are five objective accepted for enforcement of criminal law those objective being retribution which is a ought to suffer in some way, deterrence which is to impose a sufficient penalty to discourage the offender from criminal behavior, incapacitation which is designed simply to keep criminal away from society often achieved through prison sentences, rehabilitation which aims at transforming an offender into a valuable member of society, and restitution which goal is to repair, through state authority, any hurt inflicted on the victim by the offender. Before laws are enforced due to criminal punishment there is some of criminal law that must be determined. What are the aspects of Criminal Law to be determined before Criminal Law punishment is determined (Cornell Web) there is criminal Intent which is having the intentions of committing a crime by having the necessary materials or something on the sort usually created before the crime is committed.(Cornell Web) Intent may be determined through inference from facts that would give reason to believe the intent existed; for example, one could be lead to believe somebody was going to rob a store if they had necessary materials needed to pick a lock, but proof of most general criminal intent is required for the conviction of most crimes. Malice which is a state of mind that compels a person to deliberately cause unjustifiable injury to another person, although most Jurisdictions have omitted Malice from statuses for better terms to (Mckever Survey) describe intent such as purpose and knowing.
