“I do hereby pledge and declare to uphold the Constitution of the United States and the Constitution of the State of New York and faithfully discharge my duties as a New York Police Officer to the best of my ability so help me God.” This is the oath New York police officers take before officially assuming responsibilities. The day officer Daniel Pantaleo and Eric Garner cross paths this oath surely was tested.
Garner, a known street hustler, was standing in front of a convenient when approached by two officers. Eric is known for selling black market cigarettes which is illegal. The police decided to take Garner in which made Gardner furious as he stated that he is always being harassed when the police see him. He yelled, “don’t touch me,” as the officers moved towards him to apply handcuff. Garner didn’t appear to be aggressively hostile and his hands was up by his head. As one of the officer walked in the front of him, Pantaleo’s walked in the back of Garner and wrapped his arm around his neck. He was then slammed to the ground and the officer continue to choke him. The amount of force is determined by the situation. Officers supposed to avoid applying the unnecessary infliction of pain or suffering and will never engage in cruel, degrading or inhuman treatment of any person.
