The contrasting treatment of men and women in the criminal justice system can be distributed to two streams,leniency and harshness.Some concerned with leniency and ‘chivalry hypothesis’,believes women offenders are more likely to be treated leniently in accordance with their characteristics (Davies 2011).Alternatively, Cavadino and Dignan(2007) argue the occupancy of leniency continues sexist belief of women as weaker and less logical than men.
Carlen consider with the harsher treatment of female criminal ,compare with male criminals,suggest the women who fail to comply the criterion of traditional femininity are fit with the sexist prejudice.(Carlen 1983).The ‘evil women’ hypothesis claims women criminals are treated more harshly through a process of ‘double jeopardy’(Carlen 1988).For being a law breaker and also a deviant women.(Cavadino and Dignan 2007).(Carlen 1995)
