Corporate officers and directors can be held liable for their personal actions or that of their subordinates under the responsible corporate officer doctrine. An example of this is the case of People v. Roscoe. The Roscoe family owned the Customer Company which operated an underground storage tank. When the tank leaked, one of the employees, John Johnson, reported it to the Sacramento County Environmental Management Department. Subsequent to this, an environmental services firm, the Parker Environmental Services, was hired to clean up the spill.
The cleanup progressed slowly and the state department sent multiple notices to that effect. These notices were received by John Roscoe, one of the corporate officers, who regarded them as “form letters”.
