Defendant, Mel Landers, has been a delivery truck driver for Picket Up Delivery Services for ten years. He also attends part-time evening school at the local college. Prior to working, Landers was honorably discharged from the military. His wife passed away and he currently raises his son on his own. The defendant can easily be perceived as a respected working class single father who still mourns the death of his wife. His attendance at an evening school also lends to the image of Landers as a sympathetic figure. Our case will be won on the fact of the claims of Landers’ actions the day of the accident, not on his character background. Picket Up Delivery’s failure in not preventing Mel from drinking or keeping an eye on him at the party is objectively negligent. His insistence that he did not feel any effects from the drinking do not ring true, especially for someone of his physical size. Landers cannot accurately portray his own capabilities after the drinks. While two prior reported incidents of driving seems relatively average to a lay person, the defendant has some history of speeding and failing to stop when required. He continues to bandy around the idea that the stop light was yellow upon his crossing of the intersection, which has been discounted by our client and a witness.
