Police officers have a very important role in which they play when on duty. They face very different situations as to where there are mandatory arrests that they have to do and where police discretion takes place. Police discretion exists as an important factor that gives authority to the police officers to take control of the situation based on the how unusual the crime is and demand a personal decision and as well as new laws being put in place which allows police officers the right to use discretion at the time being. The police officers should not enforce the law equally in all situations because there can be different circumstances that can happen the same crime. For example a brutal murder can be arranged without a motive as to a murder that happens with the cause of self-protection, abuse, abduction, etc. The different situations that occur should require different methods of enforcement and should be civil. The individual judgment of a police officer may not always be the greatest resolution that can lead to a careless outcome. The police officer may only arrest, harass, beat the offender who in some cases might have done something minor or nothing at all just because of their age, ethnic background, gender, and health.

Police discretion should not be required to enforce the law when dealing with mandatory arrest laws, according to the individual state laws. Letting someone go with a probable cause that they committed battery within 24 hours is breaking a mandatory law that police officers must abide by in Nevada.
