I agree that there are laws in place to protect professionals in a facility when there is a need to apply restraints to a patient, especially when a behavior is warranted. Regardless of the patient behavior, consent still needs to be obtained. If the patient is unable to give consent themselves, then a legal guardian is to provide consent for the use of restraints. The wife was present during the situation in which the defendant felt the need to apply the restraints. Consent is a must in order to say that applying the restraints is lawful. It raises questions to me as to why the defendant did not obtain consent when the spouse was present.
