Artist are interpreters of the things that they hear and see. They create things to show the world how they view certain aspects of life. It is rare for one to create something entirely new to everyone. Many of the things that most artist want to create has been thought of and created already. But this doesn't stop an artist from always creating new and visually appealing imagery. With artist trying to make something new they tend to look for inspiration or reference material to help them along the way. When this happens artist sometimes fail to change enough of the original image or they accidentally plagiarize someone else's work. This can lead to many issues including problems with the law, loss of respect in the art community and self-doubt. …show more content…
A prime example of this is the artist Richard Prince. Prince is an American artist known for his use of appropriation. Although there is nothing uncommon about an artist using appropriation in their artwork, Prince takes it to a new level. One of his biggest cases is one that he won between a french photographer Patrick Cariou. Prince created a series of collages and paintings titled “Carnel Zone” that used 30 images of Cariou’s work and generated over 10 million for Prince. The initial decision by the first judge on the case was in favour of Cariou, but was later turned to the favour of Prince by an appeals court. It is said that out of the 30 paintings/collages that 25 are protected by fair use and the other 5 will have a separate hearing to determine what happens. This can be a bit controversial because Tuyman did something very similar to what Prince has and still is currently doing in his work. With Prince being a big influence in the Contemporary art world, his verdict was different because of the way the law changes between Europe and America. Prince is currently pushing the limits of what he calls “appropriation” with his recent pieces that he is selling for $40k-$100k.
