Santhi Thomas made a detailed analysis on Kanthasamy’s case in her insightful post. Kanthasamy is a Tamil who came to Canada at the age of 17, fearing for his safety after he was subjected to detention and questioning by the army and the police there. After he came to Canada, he made a claim for refugee protection and an application for a pre‑removal risk assessment, which, however, unfortunately were rejected by CIC. Finally he appealed to Supreme Court of Canada and the court made positive decision based on his actual situation.
Indeed, as a minor who came to Canada at the age of 17, Kanthasamy suffered more than other children at his age. As the court document says, the immigration officer “failed to give sufficiently serious consideration
