On this particular day, Jan (the plaintiff) went to Sam’s Beauty School (defendant) for the first time to have her hair colored dark brown. Jan had her hair colored dark brown before but the first time at Sam’s Beauty School.
Sam’s Beauty School is a privately owned beauty school, open to the public that trains students to become licensed cosmetologists where under the supervision of licensed cosmetologist perform hair services to members of the public.
On this occasion, instructors assigned a student Tom to color treat Jan’s hair. During the treatment, Jan’s hair turned green and within 24 hours Jan’s hair fell out. Since she never had any problems with hair color in the past, Jan sued Sam’s for negligence.
