Supreme Court Cases: The Marshall Trilogy

The term “Marshall Trilogy” comes from a set of landmark supreme court cases that were resided over my Chief Justice of the Supreme Court John Marshall. These court cases were major decisions regarding the on-going struggle between Native American Indians and the state of Georgia involving claims of jurisdiction or title over Indian lands in Georgia.

The first case was Johnson vs M’Intosh (1823). The findings of this case said that the Indians had the right to occupy their land, however they did not have the right to sell their land to private citizens.
