In a case called Sweatt Vs Painter an African 1950 American man named Heman Marion Sweatt applied to the University of Texas law school they denied him because the state of texas did not allow African American men or women to attend white universities. The president of the school Theophilus Painter did though offer him enrollment in school made specifically for African Americans he refused this offer and took them to court. They said that in the state of Texas the term “separate but equal” was unconstitutional and should be not be allowed anywhere in the state.
