Texas is a very unique state. The Spanish were the first to really settle in the land of Texas. It is the second largest state, Alaska being first. It was a part of Mexico and gained its independence from them in 1836 in San Jacinto. That is when they created their first constitution, which closely followed what the United States stated in their constitution, but also incorporated things that happened along with the Spanish and took in some Mexican Laws, so they could be a country of their own. They became known as the Republic of Texas. It was not until 1845 when Texas became part of the United States. The constitution of 1836 was different as to what Texas was used to. It gave the people more say than the government, and the government had limited powers. It is the Constitution that is still in effect today.
Therefore, with every great impact in the roles of government, the way things are that happened involving the U.S. and Texas, it then calls for a change in the way things were. This is where a new constitution gets established and why there are so many in Texas.
The many constitutions from Texas vary a lot from the U.S. constitution. The state constitutions are more detailed because the United States provides a basis of the necessary rules, like a guideline that needs to be followed between the government and the people on the constitution. The states have specific powers that their part of the government needs to follow, so therefore the constitution has to be amended to accommodate the regulations that come about. Also, there are things not specified in the constitution in relation to the way the other local officials govern, therefore needing a more detailed understanding of the rules for any situations. The states, Texas, also has articles in which they regulate community things, highways, transportations, schools, and healthcare.
One thing that the Texas constitution had that the U.S. does not is the protection to not be discriminated by sex. If the states don’t respect or follow with their rules then the federal comes into the play.
There are similar things that the Texas and U.S. constitutions are similar, they have religious freedom, right to bear arms, freedom of expression, and being against quartering troops, basically a good number of the Bill of Rights.
Texas has tried many times since the last constitution to revise it. They need two thirds of the votes and it falls short, therefore it has been the same as the constitution of 1876 as stated before.
