I will be discussing why the decision of the case 4.6, United States v. Windsor, was rightly decided. In case 4.6 Edith Windsor and Thea Spyer were same sex partners who lived in New York but traveled to Canada where they were lawfully married. After their marriage in Canada, they continued to live in New York where their marriage was recognized. In 2009, Spyer died and left her entire estate to Windsor. However, in 1996 Congress enacted the Defense of Marriage Act (DOMA). ADD SENTENCE This federal statute defined marriage as, “a legal union between a husband and wife. . .” (pg. 84) and defined spouse as, “ a person of the opposite sex who is husband or wife.” (pg. 84).
