Since its enactment in 1973, The War Powers Resolution has been a point of tension between the executive and legislative branches. Its intention is to “insure collective judgment” of the two branches on their divided war powers. Each of the presidents since 1973, obviously frustrated by this legislative check on his power, have claimed that this resolution is unconstitutional, because he, in fact is commander in chief. I say nay to that. It is constitutional, and here is why: The Constitution has several provisions giving congress lots of authority to pass this resolution including the necessary and proper clause, the commerce clause, the war declaration clause, and the army clause.
