The Winter Olympics Torch Relay was a school event that had educational value because students throughout the city were released from school early to watch the torch being carried throughout the city streets. Fredrick never made it to school that day because of snow in his driveway. Morse claims that “ Fredricks absence from school on the day of the torch relay was irrelevant since school policies make students who participate in school-approved events subject to school discipline.” By Frederick attending and participating in the torch relay viewing, he was submitting himself to the authority of the school. When Frederick was holding a sign that said “ Bongs Hits 4 Jesus” it was referring to the means of smoking marijuana. Given Fredriek inability to express any other credible meaning for the phrase it was not used in a political matter. And the First Amendment is designed at the very core to protect political speech, not illegal drug usage. Frederick claimed “ that the words were just nonsense meant to attract television cameras.” Even though he said the words were nonsense he did not deny that fact it was referencing illegal drugs. “ Education occurs both in and out of the classroom, and the fact that field trips and other school events take place off campus does not deprive them of their educational character.” It is acceptable for heightened scrutiny to be applied in the context of this case for school officials of the authority to apply school policies to their students. Especially when a student is attending a school- supervised event during the normal school hours, while displaying his banner across the street from the school he attended, in the view of his classmates on school
