America is known as home of the brave and land of the free. Does that apply to all situations? A highly opinionated judge named Justice Abe Fortas believes that students should be able to live by their American rights and wear black arm bands to school, while another judge named Justice Hugo Black believes school rules should become before American rights; therefore, arm bands should not be at school. Are school rules more important than constitutional rights? Justice Abe Fortas argues against the students not being able to express themselves at school. He backs his argument up by stating a quote that the Court stated that says, “do not mean that everyone with opinions or beliefs to express may address a group at any public place and any time.” One may be wondering why opinions shouldn’t be expressed at any time and place. There is a time and place and everything and Black believes that school is not the place to express an opinion of a touchy subject because it causes disruptions. He even says so in the last paragraph of the passage given. He said that there is evidence of an older football player arguing with a classmate about the armbands. The Court said that opinions cannot be expressed if disruptions are caused and a disruption was caused. Black’s evidence is reliable for that reason. The Court not allowing the armbands is already a good reason why they should not be worn, but Justice Hugo Black has something to say about the situation himself. He states his personal opinion which says, “I have never believed that any person has a right to give speeches or engage in demonstrations where he pleases when he pleases.” This is only another person supporting the Court and caring of students’ education.
