1 Prepare a short report and complete the tasks below.

Identify the following from the contract/s that you selected:

• The express terms – explain what these mean to the contracting parties
• The implied terms – explain what these mean to contracting parties

2 Considering the terms discussed in task one you must now consider what effect these terms have on each of the contracting parties in different situations, for example consider 2 of the following issues to discuss in detail:

• You have booked a holiday and a volcano erupts grounding all flights in and out of the country – (consider Act of God, rights of 3rd parties, etc.)
• Your new mobile does not work properly (you may need to refer to SOGA 1979)
• Your satellite television provider takes extra payments from your bank account without notifying you
• You have booked to see your favourite band; the lead singer has died unexpectedly.
• You have bought a product from what you thought was a reputable retailer. The product turns out to be counterfeit.
