In case 11, A Laid-Glass Worker, the Union has filed a grievance against the Company for violating the Labor Agreement in regards to Mr. Petrie. The Union accuses the company of working employees on overtime while Ronald Petrie was on lay-off and temporarily transferring employees into the department without recalling Mr. Petrie. The Union believes that the overtime and temporary transfers that went on for a period of 3-4 months were indicators of a position in the department.
The Union's position is that the company violated Article 12, Section 9 which requires a recall to be conducted in seniority order when an opening occurs in a classification from which an employee was laid off. The Union believes an opening had occurred and the senior
