Duty:
During lunch, all schools including Danger Middle School (DMS), have the duty to provide adequate supervision for students while in school and on the playground according to Educational Code 44807 and Administrative Code, title 5, § 5552 (Kemerer and Sansom, 2013, p. 455). Furthermore, under California Constitution Article I, Section 28, students also have the right to attend a campus that is considered safe, secure, and peaceful (p. 459). In addition, during lunch, schools must also provide “…each needy pupil one nutritionally adequate free or reduced-price meal during each school day…” as stated in Ed. Code 49550. Unfortunately, DMS is breaching their duties during lunch time.
