The family law portion of “Hammurabi's code was unjust because in law 129 from the source of (Doc C) it says that “if a married lady is caught [in adultery] with another man, they shall bind them and cast them into the water”. One of the reasons this law is unjust is because it prevents the two citizens from having an equal right to a fair trial, but instead they have to work off of a he said/she said case. As a result even if the man and the woman had an affair they should have had a less consequential punishment because back in the Babylonian times people would decide a case on what the man told them and what the woman told them not necessarily using factual evidence.
