I telephoned Lee at 1830 hrs and left a message to return my call at his convenience. I received a voice mail from Lee around 2030 hrs, stating he was in an auto accident and asked that I reach out to him the following day – May 4.

I reviewed the videos and information provided by Vaughan in preparation for subsequent interviews. On the morning in question – November 20, 2015 around 0233 hrs – Officer Hayes made contact with the complainant, Lee, and his passenger, Thomas Young. The video begins as Hayes is conducting license checks. Hayes is positioned at the passenger door and both men in the vehicle have their hands in plain view, Young’s hands are on the dash and Lee’s are on the steering wheel. Hayes removes the men from the vehicle one at a time and places each in handcuffs, explaining they are being detained for investigation and not under arrest.
