The Complainant is African American; therefore, she is a member of a protected class. Therefore, Complainant meets the first element of the prima facie case. At issue are the remaining elements of the prima facie case.

With regards to the second prima facia element, the Commission examined whether the Complainant applied for and was qualified to rent. Both parties agree the Complainant applied for housing on February 22, 2017, and that she was placed on a waiting list for a two bedroom unit. However, the parties disagree as to if the Complainant remained qualified to stay on the waiting list. It is the testimony of the Respondents to ensure an accurate waiting list of eligible tenants it is common practice to request eligibility documentation from potential tenants throughout the duration of their time on the waiting list. If the information is not provided within the time frame given, the applicant will be removed from the list. The Complainant provided the Commission with a letter from the Respondents dated July 10, 2017, which stated, in relevant part:
“In order for your application to remain active, you are required to fill out the attached “Personal Declaration” and return to my office on or before July 20, 2017.” “If you do not respond by July 20, 2017 your application will be declared inactive and you will be removed from the waiting
