Rape has been a common theme throughout history. In Greek Mythology, Zeus would abduct woman and commit acts of rape. By the early year of the third century A.D., rape had been defined as a forcible act of sex against woman, boys, or anyone (Schaus, 2015). Even though it had been found to be a crime, it was still used in war against the women and girls. When Constantinople fell in 1453, the Ottoman troops took the women and girls and repeatedly raped them. In the early years that it was found to be a law, rape had been taken a little more seriously as being punishable by death or loss of member. But as time went on rape was taken less seriously compared to crimes against property and social order (Schaus, 2015).
The use of rape has grown from being used as a weapon of war to being used just for fun or by men who have incontrollable needs. The FBI Uniform Crime Report states that in 2015 there were 124,047 rapes committed under the revised definition. In 2013, the FBI UCR changed the definition to “penetration, no matter how slight, of the vagina or anus with any body part or object, or oral penetration by a sex organ of another person, without the consent of the victim (www.ucr.fbi.gov).” The Uniform

If you are with someone and then break up doesn’t mean you are giving consent to future sexual acts. Allowing the defense to use this exception can allow them to bring into court prior sexual history. In rape cases, I don’t think that prior sexual history with the defendant or anyone should come into court because the victim is not on trial. The defendant should be able to prove his innocence without past sexual history. This exception can still affect the victims if the past sexual history is brought into question because they had a prior relationship. Being forcibly taken to do something against your will should be enough to prove that rape had been committed without their
