Complainant, who has a Housing Choice Voucher administered by the Chicago Housing Authority (CHA), alleges that the unit owner, Respondent Ashraf Siddiqui, Respondents Coldwell Banker’s Managing Broker, Natalie Carpenter and Real Estate Agents Stacy Cannaday and Paula Adams, refused to rent an available unit based on her source of income. Siddiqui denies that he discriminated against Complainant based on her source of income. Siddiqui admits that after he had received Complainant’s rental application but he did not submit it to the Chicago Housing Authority because the unit was unavailable based on the water damage. Respondent Coldwell Banker asserts that Respondent Cannaday showed Complainant the unit and submitted her information to Siddiqui.

The investigation revealed that on September 13, 2016, Cannaday advised Complainant that Siddiqui was again reviewing rental applications and invited her to re-apply for the unit, which Siddiqui does not acknowledge. On September 14, 2016, Complainant resubmitted her rental application and Cannaday told her that she would present her application to Siddiqui, which Siddiqui does not acknowledge. The investigation further revealed that on September 16, 2016, Cannaday told Complainant that Siddiqui required an interview prior to accepting a rental application, which Siddiqui acknowledges. However, Cannaday told Complainant that Siddiqui rejected her application, which Siddiqui does not acknowledge.

The evidence shows that Complainant was at least minimally qualified monetarily to rent a three-bedroom unit. The evidence shows that the unit rental price was $1,600 and the objective evidence shows that the Chicago Housing Authority would have subsidized a three-bedroom
