Neoclassical theory is the aftermath of the Classical theory. Classical theory had to do with free will, while Neoclassical was that insanity might inhibit free will. The second effect was to place a punishment that was consider rehabilitative to an offender. Today in the United States the criminal justice system is based on the classical and neo-classical theory.
