In this case, the officer bumps the fleeing suspect’s vehicle in the rear causing it to wreck leaving the suspect a quadriplegic. The lower court concluded that it was for a jury to decide whether it was reasonable for the officers to bump the suspect’s vehicle. The lower court also concluded that it was for the jury to decide if the suspects was driving fast and reckless enough to justify the officer’s use of deadly force. The District Court and Court of Appeals affirmed the lower court’s decision that the resolution of the immunity question raised by the deputy when he filed for summary judgment depended on unclear issues of material facts that a jury should hear.
