Issue Mr. Lance Lalumiere, who took a train with seven live oysters in a basket together and separately weighed less than six pounds, was fined $500 for transporting live animals under 6 pounds in weight without purchasing a ticket. However, Mr. Lance did not break the rule because the oysters were intended for lunch rather than other purposes.
Rules
“Live animals of greater than six pounds in weight shall be allowed on train cars if the master of the animal purchases a full-fare ticket. Live animals that weigh 6 pounds or less may be carried on a train car in a bag or basket if the master of the animal purchases a half-fare ticket for each animal.” There are two elements in this rule. One is live animals and the other is weight.
Application/Analysis
In this case, Mr. Lance brought seven oysters weighed less than six pounds in the train without purchasing a ticket for them. The rule shows that “Live animals that weigh 6 pounds or less may be carried on a train car in a bag or basket if the master of the animal purchases a half-fare ticket for each animal.” First, the seven oysters are live animals. Second, Mr. Lance’s oysters weighed less than six pounds together and separately. Thus, the two elements of the rule are satisfied. According to the rule, Mr. Lance should purchase seven half-fare tickets for each of his oysters. However, Mr. Lance was intended to eat these oysters in the train. That is to say, these animals did not finish their whole trips all the way. Mr. Lance did not transport these animals because the animals did not travel from departure to destination. Therefore, he should not be fined “$500 for transporting live animals.” In addition, people purchase tickets are for their trips from one place to another. But the oysters here should not be asked for tickets like other passengers because they did not take the whole trip. More appropriately, the oysters in such situation should be treated as food like other passengers’ lunch rather than animals.
