On the above date and time I was conducting a business check of the Walmart parking lot.

While conducting the area check, I observed a White, 4 door Mercury exiting the West side of the Walmart parking lot. I observed both the driver and passenger not wearing their seat belt. I had a clear, unobstructed view through both untinted open side and back windows. Furthermore, the vehicle'sright tail light was not functioning and a back seat juvenile was standing up and down.

When the vehicle proceded to enter Richey Drive, I activated my emergency lights and sirens to conduct a traffic stop. The final rest of both vehicles came to the parking lot of Hardees.

I exited my patrol vehicle and again observed both the driver and passengeer to be unbelted.

I then responded to Walmart and I made contact with LP supervisor, William "Bill" Dorkowski. I advised Dorkowski of the situation and I provided him with the defendant's name. Shortly after, Dorkowski confirmed the trespass warning in his computer system. Dorkowski obtained and provided me with DVD video surveillance and still photos of the defendant inside of the store with Lori. The DVD was later placed into evidence at the Port Richey Police Department.

The defendant was subsequently arrested for criminal trespassing and issued another trespass warning per request of Dorkowski. The defenant was then transported to central booking for processing without incident.

While in central booking, the defendant acknowledged and signed the trespass warning. I again advised the defendant that he would be arrested if he returned to Walmart, located at 8701 U.S. Highway 19 in Port Richey.
