Separation of power: is a way to divide the power of the government to three branches: the legislature, the executive, and the judicial. This branches are equally power, separately, and independence.
Check and balance: is a structure that give each of the three branches a validity to control over the actions of the other branches, this system allowed each branch of the three to check on the other branch.
The separation of power and check of balance are necessary because they are representing the democratic government. Thus when the necessary and proper clause gave the congress most of the power it was necessary to check and balance system in the government to prevent tyranny and injustice, and Madison famous word “ambition must be made to counteract ambition’ Confirm that.
The separation of power have co-equal system between the three branches which gives the legislature ( congress ) the power of regulate the commerce, declare war, pass all federal law, and establish the lower federal court and the number of judge. And checks on judicial by changing the jurisdiction of the federal courts, suggest constitutional amendments to exceed judicial decision and impeach federal judges. As well the executive checks on legislature by veto the legislation, perform laws passed by congress and call congress into special session. And checks on judicial by reject to implement decisions and appoint federal judges. And equally the judicial checks on legislature by ruling the federal and state unconstitutional laws. And checks on executive by declaring the executive branch unconstitutional actions and take the chair over impeachments
