Why Is Andrew Jackson Wrong

Andrew Jackson was not, at all, justified in his occupations in forcing the Indians to move out of their land. This was known as the Indian Removal Act of 1830. It was the first piece of legislation recommended and passed by Jackson. The reasoning for this is that the Supreme Court did not authorize the act. In fact, they stated that it could not be done. As well as this, the Indians were treated in an extremely brutal manner. Furthermore, the land originally belonged to the Indians. Therefore, it is unjust to force them out of it. It is clear that Andrew Jackson’s irrational behaviors are unacceptable.

The Cherokee tribe, instead of fighting a hopeless battle, went to the Supreme Court. The Chief Justice, John Marshall, ruled in favor of the Cherokee tribe. Some people believe that John Marshall’s role as Chief Justice is equally or more as powerful as the President. Anyways, according to the article, “The Trail of Tears” states that Marshall ruled, “In which the laws of Georgia [and other states] can have no force.” In other words, the Supreme Court supported the Cherokee in the fact that President Jackson’s irrational behavior was not constitutional and it illegally violated the treaties that the Native Americans signed with previous president. This is completely hypocritical, since he is supposedly attempting to prevent invasions in the future. To take their land, simply because of their race is absolutely absurd. Native Americans are people as well and should have been treated as
